Thank you for choosing Grini’s Bakery. These terms and conditions serve as the contract between customer and Grini’s Bakery. By placing an order and paying an invoice with Grini’s Bakery, the customer is agreeing to these terms and conditions: 

Our Guarantee

Grini’s Bakery will provide a professionally decorated dessert in a timely manner as specified in the invoice or contract.  We appreciate your business and we are honored that you have chosen us for your special celebration. We guarantee that the flavors, size, and general design elements will be met as outlined. If you are not satisfied with our product(s) please let us know at the time you receive your order. Once your order is accepted, refunds will not be considered. 

Allergy Disclaimer

All our cakes contain gluten, eggs and dairy products, and are not suitable for those suffering from intolerance or allergies to these particular foods. It’s the customer’s obligation to inform Grini’s Bakery in a written form of any dietary requirements. Although our products do not contain nuts, please be aware that any additional designs to our cakes, such as candy, may contain traces of nut. Grini’s Bakery will not be held responsible for anyone suffering from the allergies listed. Non-edible items, such as picture logos and sugar flowers, may be used as decorations or packaging for the cakes. It is your responsibility to ensure that any non-edible items are removed prior to consumption.

Deposits/Payments

All customized cakes require a non-refundable deposit of 50% or more and a signed contract for services to be rendered.  The remaining balance is due the day of pick up or at least two business days prior if order is a delivery. If full payment is not received the due date, the order may be cancelled.

Cancellations

Changes and cancellations to retail orders are accepted until 120 hours (5 days) prior to scheduled pick up or delivery time. There will be no credit given for orders cancelled inside of five (5) business days. For cancellations with more than five (5) business days’ notice, credit may be given for a future order within three (3) months from date. This offer is subject to the date being available.

Please note that if cake order is not picked up at contracted time or if customer did not call Grini’s Bakery to advise of different pick-up time and date before contracted time, customer risks the possibility of having cake cancelled and refunds will not be considered.  

Refund Policy

Grini’s Bakery will not offer refunds or exchanges for custom products that meet our quality standards once a cake has been picked up/delivered and “Accepted” by you or another designated party. Additionally, under no circumstances will Grini’s Bakery provide a refund in excess of the cost of the order. All products are the responsibility of the customer once it leaves our possession. Refund requests due to decorating style, color shade or general decoration design will not be honored or considered. We only give refunds if the product does not meet the flavor, size, and general description detailed above.

Cake flavor and texture is subjective. Refunds requested due to flavor or texture after cake has been accepted and picked up will be at the sole discretion of Grini’s Bakery.  Grini’s Bakery may consider a store credit if the product is brought back to us and the quality of the cake flavor or texture is determined not to meet our standards within 24 hours of your event. Please note, we do taste our cakes daily to insure the highest quality. Quality determination is solely at the discretion of Grini’s Bakery. Our cakes are baked from scratch with all natural ingredients, and need to be kept out at room temperature. Keep in mind, variety in temperature and humidity may impact the flavor, overall design, or texture of the cake to some degree. Please understand we cannot control changes in texture or changes in color or shape due to weather conditions.

Alterations and Changes

Any changes to customer’s cake order must be made at least 72 hours or five (3) business days prior to pick-up or delivery. It is your responsibility to read & check the quote thoroughly; any amendments should be made in person or over the phone with a representative. Any changes requested after the signing of an order invoice cannot be guaranteed and may be subject to additional charges.

Design Variations

Although we make every attempt to provide an exact design and to match colors, custom cakes are a work of art. Every order is hand-made and decorative finishes are done by hand and are subject to the artistic interpretation of our expert cake decorators. You may provide us with a photograph for inspiration and duplication; however, we make no claims for exact duplication of the work done by other cake decorators. It may not be possible to match an exact shade of a color or design, but we will do our best to come as close as possible. The final product may be subject to slight variations.  

Also, be aware the exposure to light and various temperatures can cause colors to change. We do not offer discounts or refunds if the exact shade of a color or design is not achieved or if a variation occurs due to lighting and temperature. Any additions to the cake, such as flowers, sprinkles, ice cream cone, etc., will be based upon what is in stock at the time of cake order. In the event that a major variation needs to be made, Grini’s Bakery will communicate this to the customer and seek re-design approval.

Care and Handling

We are not responsible for any damage to the cake after pick-up or after setup is complete.  The customer is responsible for secure transportation (placing cake on a flat surface in vehicle) and providing an appropriate and firm table and environment for the cake(s).  Please note that some of our cakes may be exposed in its cake package due to size when given to you. It is important that customer’s cake is left in its package as is when handed to customer to avoid damaging the cake. Our cakes require optimal room temperature of 75 degrees or below.                             

If you or your representative elects to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves the possession of Grini’s Bakery.  Grini’s Bakery is not responsible for any damage to the cake caused by the placement of flowers by another party or other items on the cake. If damage does occur outside of Grini’s Bakery, customer may arrange with store manager to fix/re-decorate cake (subjected to availability and charges; no refunds provided).

Delivery Conditions:

Grini’s Bakery cakes can be collected directly or delivered to you at a requested address. Delivery is by arrangement only and charges apply. It is essential that when delivery is confirmed, someone is at designated location to receive the cake(s). If for any reason, based on the agreed receiving timing and location, customer is unable to receive the products, we will return cake back to main location and customer can either arrange to collect within next 24 hours or arrange for redelivery (subjected to availability and charges; no refunds provided).

The Customer must disclose any adverse road hazards and/or obstacles that may hamper the delivery and quality of finished products.  In the case of an unavoidable occurrence, such as a car accident, poor road conditions, or dropping of cake during delivery — Grini’s Bakery cannot be held liable for more than the price of the cake described in customer invoice.

Rental Items

All rental items will be for a seven (7) day period. The day of the event and up to six (6) days after. A late fee of $25.00 per day will be imposed for each day the items are late. Should any parts be not returned or damaged in any way, the renter will be responsible for the cost of replacing the entire item. A returnable security deposit will be refunded when ALL rental items are returned in the same condition.

Photographs and Marketing

We respect the privacy of all our customers. We will not disclose the identity of customers (photographs of people, last names, event details, contract details) without permission. We do however, reserve the right to photograph baked goods and use those photos on our website, social media, or marketing materials. We also reserve the right to use any photographs for display or promotion without compensation to you.

Resolution of Disputes

All claims, disputes, and other matters in question arising out of or relating to this Agreement, or the breach of this Agreement (in any event, a “Dispute”) shall first be submitted to non-binding mediation in accordance with the Commercial Arbitration Rules and Mediation Procedures of the American Arbitration Association. Unless agreed upon by the parties, the mediator shall be selected by the Alternative Dispute Resolution Section of the Passaic County Bar Association. The mediator may offer such guidance as the mediator deems appropriate to facilitate the resolution of the Dispute.

Privacy Policy

This website collects various types of information, such as: (1) Voluntarily provided information which may include your name, address, email address, billing and/or credit card information etc., which may be used when you purchase products and/or services and to deliver the services you have requested. (2) Information automatically collected when visiting our website, which may include cookies, third party tracking technologies and server logs. Grini’s Bakery does not now, nor will it in the future, sell, rent or lease any of its customer lists and/or names to any third parties.

 

Grini’s Bakery reserves the right to change the terms of service, including this privacy policy, at any time, without advanced notice.
